By accessing the Site, creating an account, placing an order, purchasing a product, or otherwise using our Services, you acknowledge that you have read, understood, and agree to this Legal Notice and our other applicable store policies, including our Terms of Service, Privacy Policy, Shipping Policy, Return & Refund Policy, Product Disclaimers, and Made-to-Order Policies.

3. MADE-TO-ORDER, HANDCRAFTED AND CUSTOM PRODUCTS

A substantial portion of the products available through Modern Baby Las Vegas LLC may be made-to-order, handcrafted, customized, printed, fabricated, assembled, personalized, or otherwise produced or prepared after an order is placed.

Any item that requires production, preparation, customization, fabrication, printing, assembly, or other processing time before shipment may be considered a Made-to-Order item, regardless of whether the product description specifically uses the words “Made-to-Order,” “Custom,” “Handmade,” “Printed,” or “Personalized.”

Made-to-Order and handcrafted products may contain reasonable variations from website photographs or model/reference images.

Variations may include, without limitation:

• Color;
• Materials;
• Texture;
• Pattern;
• Embellishments;
• Hardware;
• Stitching;
• Proportions;
• Finishing;
• Placement of decorative elements;
• Printing;
• Construction;
• Shape; and
• Other production details.

These variations may occur as a natural consequence of individual production and do not necessarily constitute a defect.

Our independent designers, artisans, and production partners make reasonable efforts to create products as close as reasonably possible to the applicable product photographs and descriptions. Exact duplication cannot be guaranteed.

Customers seeking a mass-produced product guaranteed to be identical to a photograph should carefully consider whether a made-to-order or handcrafted product is appropriate for their needs before purchasing.

4. INDEPENDENT DESIGNERS, ARTISANS AND PRODUCTION PARTNERS

Certain products sold through Modern Baby Las Vegas LLC may be created, produced, fulfilled, or supplied by independent designers, artisans, vendors, suppliers, or other third-party production partners.

Production methods, materials, sizing standards, quality-control procedures, manufacturing times, and return policies may differ among independent designers and production partners.

Where applicable, the policies governing a particular product may depend upon the independent designer or production partner responsible for creating or fulfilling that product.

Customers should carefully review the applicable product description and store policies before purchasing.

5. CHILDREN'S PRODUCTS AND PARENTAL SUPERVISION

Products intended for babies, children, or minors must be used only for their intended purpose and in accordance with all applicable product instructions, warnings, age recommendations, assembly instructions, and safety information.

Parents, guardians, caregivers, and supervising adults are responsible for determining whether a product is appropriate and safe for the particular child using it.

Children and infants should never be left unattended with products that may present choking, suffocation, entanglement, falling, tipping, strangulation, or other hazards.

Where a product includes manufacturer, designer, vendor, or supplier safety instructions or warnings, those instructions should be carefully reviewed and followed.

Nothing in this Legal Notice is intended to waive or limit any product-safety obligation or liability that applicable law does not permit to be waived or limited.

6. PRODUCT USE AND ASSUMPTION OF RISK

Customers are responsible for using products according to their intended purpose and applicable instructions.

To the fullest extent permitted by law, customers acknowledge that improper use, misuse, alteration, improper assembly, failure to follow instructions, failure to properly supervise a child, or use of a product contrary to its intended purpose may create risks that are not attributable to the Company.

Modern Baby Las Vegas LLC is not responsible for harm caused by a customer's misuse, unauthorized modification, improper assembly, failure to follow provided instructions, or other use contrary to applicable instructions or warnings, except to the extent liability cannot legally be excluded or limited.

7. NO BLANKET WAIVER OF PRODUCT LIABILITY

Modern Baby Las Vegas LLC does not intend this Legal Notice to serve as a blanket waiver of product liability or other liability that cannot legally be waived.

Nothing in this Legal Notice limits any rights or remedies a customer may have under applicable federal or state law concerning defective products, personal injury, consumer protection, fraud, or other claims for which liability cannot lawfully be excluded.

Where applicable law permits limitation or exclusion of liability, Modern Baby Las Vegas LLC intends to exercise those rights to the fullest extent permitted by law.

8. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Modern Baby Las Vegas LLC, its owners, members, managers, employees, contractors, affiliates, agents, service providers, independent designers, and business partners shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to:

• Use of or inability to use the Site;
• Products purchased through the Site;
• Delays in production;
• Shipping or carrier delays;
• Website interruptions;
• Errors or omissions;
• Third-party services;
• Customer misuse of products;
• Unauthorized modifications;
• Failure to follow instructions or warnings; or
• Other matters arising from use of the Site or Services,

except where such liability cannot legally be excluded or limited.

To the fullest extent permitted by applicable law, the Company's aggregate liability arising from a particular transaction shall not exceed the amount actually paid to Modern Baby Las Vegas LLC for the product or service giving rise to the claim.

This limitation does not apply to liability that applicable law prohibits the Company from limiting or excluding.

9. SHIPPING DISCLAIMER

Shipping and delivery timeframes are estimates unless expressly stated otherwise in writing.

Production time for Made-to-Order, handcrafted, customized, printed, fabricated, or otherwise specially prepared products is separate from carrier shipping and delivery time.

Once an order has been properly shipped and transferred to the applicable carrier, the package is in the carrier's possession.

Modern Baby Las Vegas LLC is not responsible, to the fullest extent permitted by law, for carrier delays, carrier errors, lost packages, misrouted packages, packages marked delivered but not located, or packages stolen after delivery.

Customers are responsible for providing a complete and accurate shipping address, including any applicable apartment, suite, unit, building, floor, or other delivery information.

If an incomplete or incorrect address is provided and the package cannot be properly delivered, the customer may be responsible for any resulting carrier charges, reshipping expenses, or other applicable costs.

10. LOST, MISSING, OR STOLEN PACKAGES

Once an order has been transferred to the mail carrier, customers should direct delivery-related claims to the applicable carrier.

If tracking indicates that a package has been delivered but cannot be located, customers should first check with household members, neighbors, building management, mailrooms, leasing offices, and other appropriate locations before contacting the carrier.

Where appropriate, customers may be required to file a carrier claim.

Modern Baby Las Vegas LLC may provide available shipment and tracking information but does not control the carrier's investigation, delivery process, or claim determination.

11. FALSE OR FRAUDULENT SHIPPING CLAIMS

Customers must provide truthful information when reporting an order as lost, missing, stolen, or undelivered.

Knowingly claiming that an order was not received when the customer actually received the order is strictly prohibited.

A customer may not falsely characterize a product as “lost,” “missing,” “stolen,” or “undelivered” because:

• The item does not fit;
• The wrong size was selected;
• The customer changed their mind;
• The customer no longer wants the product;
• The product is not eligible for return; or
• The customer wants to obtain a refund or other financial benefit outside of the applicable store policy.

Knowingly submitting a false or fraudulent shipping claim may result in permanent termination of purchasing privileges and other action permitted by applicable law.

12. RETURNS, REFUNDS, AND EXCHANGES

Returns, refunds, store credits, and exchanges are governed by our Return & Refund Policy.

Not every product is eligible for return, refund, cancellation, or exchange.

In particular, certain custom, handcrafted, Made-to-Order, personalized, printed, or otherwise specially produced products may be final sale.

Customers are responsible for reviewing the applicable Return & Refund Policy and product-specific restrictions before purchasing.

Nothing in this Legal Notice overrides rights that cannot legally be waived under applicable law.

13. SIZING AND FIT DISCLAIMER

Customers are responsible for carefully reviewing all available sizing information before placing an order.

Certain products may use Asian, European, international, designer-specific, or other sizing standards that differ from standard U.S. sizing.

Customers should not assume that their usual U.S. size will fit.

If a size chart is not available on the product page, customers should contact our Support Team before ordering to request applicable sizing information.

Modern Baby Las Vegas LLC is not responsible for sizing or fit issues resulting from a customer's failure to review available sizing information or request applicable sizing information before purchasing, subject to rights that cannot legally be excluded.

14. PRICING, AVAILABILITY, AND WEBSITE ERRORS

We make reasonable efforts to maintain accurate pricing, product information, inventory information, promotions, and availability.

However, the Site may occasionally contain typographical errors, pricing errors, incorrect information, omissions, or technical errors.

This may include cancellation of transactions, restriction of purchasing privileges, permanent account termination, submission of documentation to payment providers, and pursuit of other lawful remedies.

A customer who knowingly submits fraudulent information or a fraudulent claim may be permanently banned from purchasing from Modern Baby Las Vegas LLC.

Nothing in this section is intended to prohibit a customer from exercising a lawful consumer right or submitting a legitimate dispute.

20. INDEMNIFICATION

This provision does not require you to indemnify the Company for liability that cannot legally be shifted to you.
